Limitation of Liability
- Agency Role
The Company acts solely as a booking agent and coordinator for independent third-party suppliers, including but not limited to airlines, hotels, transport operators, guides, activity providers, and insurers (“Suppliers”). The Company does not own, operate, or control such Suppliers and is not responsible for their acts or omissions. - Standard of Care
The Company shall exercise reasonable skill and care in the selection and coordination of Suppliers. Except as expressly set out herein, all services are provided by Suppliers on their own terms and conditions. - Exclusion of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for any loss, injury, illness, death, damage, delay, inconvenience, or additional expense arising from:
(a) acts or omissions of any Supplier;
(b) events beyond the Company’s reasonable control, including those described under Force Majeure;
(c) changes to itineraries necessitated by operational, safety, or local conditions; or
(d) the Client’s failure to comply with travel requirements (visas, passports, vaccinations, insurance, or local laws). - Indirect and Consequential Loss
The Company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of enjoyment, loss of profits, or missed connections, however caused. - Liability Cap
Where liability is established notwithstanding the foregoing, the Company’s total aggregate liability arising out of or in connection with the booking shall not exceed the amount of fees actually received by the Company for the specific services giving rise to the claim. - Claims & Time Limits
Any claim must be notified in writing during the trip or within 14 days of the end of services, with supporting evidence. Failure to provide timely notice may prejudice the claim. - Indemnity
The Client agrees to indemnify and hold harmless the Company, its directors, employees, and agents from any claims, losses, or expenses arising from the Client’s acts, omissions, or breach of these Terms. - Insurance
Comprehensive travel insurance (including medical, evacuation, trip interruption, and personal effects) is strongly recommended and may be required for certain itineraries. The Company is not an insurer. - Non-Excludable Rights
Nothing in this clause excludes or limits liability to the extent such liability cannot be excluded under applicable law.
Force Majeure
- Definition
“Force Majeure Event” means any event beyond the reasonable control of the Company or Suppliers, including but not limited to: natural disasters, extreme weather, epidemics/pandemics, acts of God, fire, flood, earthquake, war, terrorism, civil unrest, strikes or labor disputes, government actions or restrictions, border closures, quarantine measures, transportation disruptions, or infrastructure failure. - Effect on Performance
Where a Force Majeure Event affects the performance of services, the Company and/or Suppliers may, without liability, modify, postpone, or cancel any part of the itinerary in the interest of safety or feasibility. - No Liability for Losses
The Company shall not be liable for any losses, delays, additional costs, or damages incurred as a result of a Force Majeure Event. - Credits & Refunds
Any refunds, credits, or re-booking options shall be subject to the terms imposed by the affected Suppliers. The Company will use reasonable efforts to secure favourable outcomes but does not guarantee refunds where Suppliers do not provide them. - Mitigation & Assistance
The Company will use reasonable endeavours to assist Clients with alternative arrangements; however, any additional costs arising from such changes shall be borne by the Client unless otherwise agreed in writing.
All the disputes arising out of any discontent shall be under the jurisdiction of state of New Delhi, India.
